Terms of Service

1. Scope of Document

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the James Scott Brown Foundation ("JSBF," "Foundation," "we," "us," or "our"), governing your access to and use of the JSBF Legal Intelligence Platform located at jamesscottbrownfoundation.com (the "Platform"), including all associated services, tools, content, and features. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must discontinue use of the Platform immediately.

2. Definitions

  • "Platform" refers to the JSBF Legal Intelligence Platform, including the website at jamesscottbrownfoundation.com, all subdomains, APIs, and associated digital services.
  • "Services" refers to the legal intelligence tools, document analysis capabilities, Multi-Phase Processing Technology (MPPT) deep analysis, case management features, and all other functionalities provided through the Platform.
  • "User" refers to any individual or organization that accesses, browses, or uses the Platform in any capacity.
  • "Content" refers to all text, data, files, documents, images, and other materials uploaded to, generated by, or displayed on the Platform.
  • "Foundation" refers to the James Scott Brown Foundation, a nonprofit organization dedicated to combating child abuse and exploitation through legal intelligence services.
  • "Authorized Representative" refers to an individual who has legal authority to act on behalf of an organization using the Platform.

3. Eligibility and Account Access

The Platform is designed to serve nonprofit organizations engaged in child protection work. To access certain features, you must be at least thirteen (13) years of age, or sixteen (16) years of age if you are located within the European Economic Area. Users under the age of eighteen (18) must have verifiable parental or guardian consent before submitting any personal information through the Platform, including service applications.

By creating an account or accessing authenticated features, you represent and warrant that you possess the legal capacity to enter into these Terms and that all information you provide is accurate, current, and complete. The Platform uses third-party authentication services for account management. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Core Terms and Acceptable Use

JSBF grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform in accordance with these Terms. All services provided through the Platform are funded by grants and are offered at no direct cost to qualifying organizations. This grant-funded model does not create an entitlement to continued service, and JSBF reserves the right to modify, suspend, or discontinue any service at any time without prior notice.

You agree not to engage in any of the following prohibited activities:

  • Using the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation.
  • Submitting false, misleading, or fraudulent information in any application, form, or communication.
  • Attempting to gain unauthorized access to any portion of the Platform, other user accounts, or any systems or networks connected to the Platform.
  • Using automated scripts, bots, scrapers, or other automated means to access, collect, or interact with the Platform without express written authorization.
  • Interfering with or disrupting the integrity, performance, or availability of the Platform or its underlying infrastructure.
  • Uploading, transmitting, or distributing any malicious code, viruses, or other harmful content.
  • Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
  • Using the Platform to harass, abuse, threaten, or intimidate any individual or organization.
  • Reproducing, distributing, modifying, or creating derivative works from any Platform content without express written permission.
  • Using any legal analysis, document, or output generated by the Platform as a substitute for licensed legal counsel.

5. Intellectual Property and Content

All intellectual property rights in the Platform, including but not limited to software, algorithms, designs, text, graphics, logos, and trademarks, are and remain the exclusive property of JSBF or its licensors. Nothing in these Terms transfers any intellectual property rights to you.

By uploading or submitting content to the Platform, you grant JSBF a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze such content solely for the purpose of providing the requested Services. You retain all ownership rights in your original content. JSBF will not sell, license, or distribute your uploaded content to third parties except as required to deliver the Services or as compelled by law.

6. User Rights and Obligations

As a User of the Platform, you have the right to:

  • Access and use the Platform's publicly available features in accordance with these Terms.
  • Request access to your personal data held by the Foundation.
  • Request correction or deletion of inaccurate personal data.
  • Request a portable copy of your personal data in a structured, machine-readable format.
  • Withdraw consent for data processing where consent is the legal basis for processing.
  • Lodge a complaint with a supervisory authority if you believe your data rights have been violated.

You are obligated to provide accurate and truthful information in all interactions with the Platform, to comply with all applicable laws and regulations, and to promptly notify JSBF of any unauthorized use of your account or any security breach you become aware of.

7. Platform Rights and Limitations

JSBF reserves the right, at its sole discretion, to:

  • Modify, suspend, or terminate any User's access to the Platform at any time, with or without cause, and with or without notice.
  • Remove or refuse to process any content that violates these Terms or that JSBF deems inappropriate, harmful, or inconsistent with the Foundation's mission.
  • Implement technical measures to prevent unauthorized access, scraping, or abuse of the Platform.
  • Cooperate with law enforcement authorities and comply with valid legal processes, including subpoenas, court orders, and regulatory requests.
  • Modify the features, functionality, or availability of any Service at any time.

The Platform is not a law firm and does not provide legal advice. All legal intelligence outputs, analyses, and documents generated through the Platform are intended for informational and educational purposes only. Users must consult with licensed legal professionals before acting on any information obtained through the Platform. JSBF does not establish an attorney-client relationship with any User.

8. Compliance

JSBF operates in compliance with applicable data protection and privacy regulations across the jurisdictions in which the Platform is accessible. The Foundation implements administrative, technical, and organizational safeguards designed to protect User data in accordance with industry standards and regulatory requirements. Data processing activities are conducted on lawful bases, including consent, contractual necessity, legitimate interest, and legal obligation, as applicable to each processing activity.

Users located in the European Economic Area, the United Kingdom, or other jurisdictions with specific data protection frameworks are afforded the rights and protections described in those frameworks. Users located in the United States, including residents of states with consumer privacy legislation, are afforded applicable opt-out and data access rights. 9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. JSBF EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

JSBF DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. JSBF DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, ANALYSIS, OR OUTPUT GENERATED THROUGH THE PLATFORM.

IN NO EVENT SHALL JSBF, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF JSBF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, JSBF'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the jurisdiction in which the Foundation is organized, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered by a recognized arbitration body, unless the parties mutually agree to an alternative dispute resolution mechanism.

For Users located within the European Economic Area, nothing in these Terms shall limit any rights afforded under mandatory consumer protection laws of the User's country of residence. Such Users retain the right to bring claims in the courts of their country of residence to the extent required by applicable law.

11. Updates and Modifications

JSBF reserves the right to modify these Terms at any time. When material changes are made, the Foundation will update the "Effective Date" at the top of this page and, where practicable, provide notice through the Platform. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of such changes. If you do not agree to the modified Terms, you must discontinue use of the Platform.

JSBF encourages Users to review these Terms periodically to remain informed of any updates. The most current version of these Terms will always be available at this URL.
