By accessing or using the James Scott Brown Foundation Legal Intelligence Platform at jamesscottbrownfoundation.com (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you (or the organization you represent) and the James Scott Brown Foundation ("JSBF," "we," "us," or "our").
JSBF provides a suite of 30 legal intelligence services designed to support nonprofit organizations working in child protection and abuse prevention. These services include legal research, case analysis, document generation, compliance review, and related tools. All services are provided free of charge through a grant from the Embassy Row Project. JSBF reserves the right to modify, suspend, or discontinue any service at any time without prior notice.
The Platform is intended for use by nonprofit organizations, government agencies, and other entities engaged in child protection, abuse prevention, and related advocacy work. By using the Platform, you represent and warrant that you are authorized to act on behalf of your organization and that your organization meets the eligibility criteria for accessing our services. Individual users must be at least 18 years of age.
The information, analyses, and documents generated through the Platform are provided for informational and research purposes only. They do not constitute legal advice, legal representation, or the establishment of an attorney-client relationship. JSBF is not a law firm and does not provide legal counsel. All legal decisions and actions should be made in consultation with your organization's licensed legal counsel. JSBF serves as a force multiplier for your existing legal team, providing research, analysis, and intelligence to support their work.
When using the Platform, you agree to:
All content, design, code, trademarks, logos, and other intellectual property on the Platform are owned by or licensed to JSBF and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent. Documents and analyses generated through the Platform for your organization's use may be used by your organization for its intended child protection purposes.
Organizations seeking access to certain Platform features or White Glove Services must complete an application. JSBF reserves the sole right to approve or deny any application at its discretion. Approval of an application does not guarantee continued access. JSBF may revoke access at any time if an organization is found to have violated these Terms, provided false information, or is no longer aligned with the mission of child protection.
We understand that the information submitted through our Platform may be highly sensitive, particularly when it involves child abuse cases. We are committed to maintaining strict confidentiality of all user-submitted data. Users are equally responsible for maintaining the confidentiality of any information, analyses, or documents they receive through the Platform, especially when such materials contain sensitive case information.
The Platform and all services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. JSBF disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure, or that any results generated through our services will be accurate, complete, or suitable for any particular legal proceeding.
To the fullest extent permitted by law, JSBF, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform. This includes, without limitation, damages for loss of data, loss of revenue, or any decisions made based on information provided through the Platform. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed one hundred dollars ($100).
You agree to indemnify, defend, and hold harmless JSBF, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
JSBF reserves the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless otherwise required by applicable law.
We may revise these Terms at any time by posting the updated version on this page with a revised "Last updated" date. Material changes will be communicated through the Platform. Your continued use of the Platform after the posting of revised Terms constitutes your acceptance of the changes.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
